Aim and scope
This is the official Internet presence of the Shark Foundation / Hai-Stiftung and its affiliates (hereinafter Shark Foundation). The Internet presence of the Shark Foundation is intended for providing information to the visitors of our sites and offers various services.
These rules on use of our Internet presence cover all web pages run by the Shark Foundation. Special regulations are explicitly reserved. The conditions covering use of our Internet presence are applicable in the current versions. Content may be changed or deleted or be temporarily unavailable at any time.
By accessing or using the the Shark Foundations website - including all sites within the domains owned by the Shark Foundation (e.g. hai.ch, hai.swiss, hai-stiftung.ch, haistiftung.ch, haistiftung.org, hai-stiftung.org, sharkinfo.ch, sharkinfo.org, shark-info.ch, shark.ch, shark.swiss, requins.ch, pescecane.ch, sharkfoundation.org) - hereinafter referred to as The Website, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions.
Amendments to these Terms and Conditions will be posted at this URL and will be effective when posted. Your continued use of The Website following the posting of any amendment, modification or change shall constitute your acceptance thereof. -
Intellectual property and other rights
The Shark Foundation owns and operates this Internet presence. All content, trademarks, names, headers, logos, images, designs, texts and other material used herein and the actual webpages are the property of the Shark Foundation or the named rights holders. Access to, downloading or copying of content, webpages, trademarks, logos, designs, texts or other material does not constitute acquisition of rights (rights of use, intellectual property rights) or transfer of copyright; the right to specific service conditions is reserved. Reproduction (in whole or in part), transmission (electronically or otherwise), modification, linkage, dissemination or use of the Internet presences or its webpages without prior permission from the Shark Foundation is prohibited and subject to criminal prosecution.

Non-liability
The Shark Foundation excludes liability for damages resulting from access or inability to access webpages. Access to webpages, specific services and their use is not guaranteed. In particular the Shark Foundation especially assumes no liability for the completeness, correctness, accuracy, topicality and reliability of the information published or the third party information accessible through links on some web pages. The Shark Foundation cannot be held liable for the security of data transmitted on the internet. All liability for indirect damage or damage caused by auxiliary persons of the Shark Foundation is excluded.

Data protection and security (Privacy)The Shark Foundation takes data protection very seriously.
Data protection serves to protect the privacy of individuals. It requires data processors to act lawfully, and confers enforceable rights to the affected persons with regard to the processing of their personal data. Section 3 of the Canton of Zurich's Act on Information and Data Protection (Gesetz über die Information und den Datenschutz [IDG ZH]) defines personal data as any information related to an identified or identifiable individual. This includes details such as names, addresses, phone numbers, and email or IP addresses.
Every time a Shark Foundation web page is requested or called up, the following access data are collected and stored in a web server file on Shark Foundation's servers:- The IP address of the requesting computer (e.g. 123.123.12.12)
- The site or address (URL) from which the Shark Foundation web page was requested
- The path and name of the requested Shark Foundation web page
- The date and time of the request (e.g. [12/Apr/2016:00:00:01 +0200])
- The volume of data transferred
- The access status
- The type of access
- A description of the type of web browser and/or operating system used
- The session ID
- The serial number of the requesting computer
These data are processed for the following purposes:
- Safeguarding the network infrastructure and facilitating technical administration
- Optimizing the use of specific web offerings
- IIdentifying and tracking unauthorized access attempts
Use of specific functions or services on the Internet presence of the Shark Foundation (e.g. newsletters, contact forms, and web applications) may require further collection, processing, and long-term storage of personal data such as names, addresses, and email addresses. By entering and sending this data, you give your consent for this information to be processed.
Personal data will be disclosed to third parties (e.g. other authorities) only if required by binding legal provisions (e.g. the ruling of an authority, court orders) or for the purposes of legal or criminal prosecution (e.g. in the event of attacks on the Shark Foundation's Web contents). Personal data will not be disclosed to third parties for other purposes.
Nevertheless, the Shark Foundation may commission service providers to process data collected via the the Shark Foundation's Internet presence for the purposes described above. Legal, technical, and organizational measures will be put in place requiring the Shark Foundation and external service providers to comply with the relevant provisions of data protection law.
The data protection statement applies only to Shark Foundation's Internet presence. In the case of links providing access to external sites, please refer to the data protection policies of the providers in question. Shark Foundation is not responsible for the content or for the data protection policies of these providers. In particular, Shark Foundation cannot guarantee that content provided by other providers is free of malware. -
Visitor Tracking
The Shark Foundation stores and archives some access data when you access our web pages (e.g. IP address, access date and time, name of file retrieved) to comply with its legal obligations. We do not carry out personal analyses. Data is analysed anonymously for statistical purposes.
Personal data is treated as strictly confidential. It is processed only by the Shark Foundation or its representatives and is not disclosed or made available to third parties. Secure filing of personal data is guaranteed. -
CookiesA cookie is a small file of letters and numbers that, with your agreement, we put on your computer, tablet or mobile device.
Our Site uses several cookies. By using our Site, you agree that we may place these and other similar types of cookies on your device and access them when you visit the Site, e.g. in the future.
The cookies we use are primarily analytical cookies that aid us in improving both our Site and your experience, making the Site easier to navigate, to count visits, and to allow a registered user to remain signed in to his/her user profile throughout a visit. We may also use cookies placed on our Sites by third parties acting on our behalf. -
Customer account/registration
If you create a customer account with us via our website, we will use the data you entered during registration (e.g. your name, your address, or your email address) exclusively for services leading up to your potential placement of an order or entering some other contractual relationship with us, to fulfill such orders or contracts, and to provide customer care (e.g. to provide you with an overview of your previous orders or to be able to offer you a wishlist function). We also store your IP address and the date and time of your registration. This data will not be transferred to third parties.
During the registration process, your consent will be obtained for this processing of your data, with reference made to this privacy policy. The data collected by us will be used exclusively to provide your customer account.
If you give your consent to this processing, Art. 6 Para. 1 lit. a) GDPR is the legal basis for this processing.
If the opening of the customer account is also intended to lead to the initiation of a contractual relationship with us or to fulfill an existing contract with us, the legal basis for this processing is also Art. 6 Para. 1 lit. b) GDPR.
You may revoke your prior consent to the processing of your personal data at any time under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent.
The data previously collected will then be deleted as soon as processing is no longer necessary. However, we must observe any retention periods required under tax and commercial law.

Our website uses Google reCAPTCHA to check and prevent automated servers ("bots") from accessing and interacting with our website. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland (hereinafter: Google).

Google guarantees that it will follow the EU's data protection regulations when processing data in the United States.
This service allows Google to determine from which website your request has been sent and from which IP address the reCAPTCHA input box has been used. In addition to your IP address, Google may collect other information necessary to provide and guarantee this service.
The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the security of our website and in the prevention of unwanted, automated access in the form of spam or similar.

To enable the display of certain fonts on our website, a connection to the Google server in the USA is established whenever our website is accessed.
The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the optimization and economic operation of our site.
When you access our site, a connection to Google is established from which Google can identify the site from which your request has been sent and to which IP address the fonts are being transmitted for display.

Governing Law, Disputes
Any dispute, controversy or claim arising under or pursuant to these Terms and Conditions shall be settled by mutual agreement between the Shark Foundation and the User.
If the Shark Foundation and the user are unable to reach agreement amicably the dispute, controversy or claim shall be submitted to responsible court of Zürich, Switzerland.
